Topic: Investigations Primer in a Remote Workplace
Human Resource professionals must keep up with the ever-changing way we do business in a pandemic. This includes investigating complaints of misconduct, which have been on the rise. Many investigative interviews are being conducted remotely, which requires adaptability and changes to the process. Issues include planning, preparation, timing, technology, effective communication, credibility determinations, confidentiality, and privacy. Pre-interview communications with the parties and witnesses are also important to lay the groundwork for a productive interview. Our Speakers: Julie Moore, Deborah Maddux and Sue Ann Van Dermyden
Julie A. Moore is president and founder of Employment Practices Group in Wellesley, MA. She founded EPG in 1998 to work with employers on employment law issues and preventative strategies and best practices of human resource management. Julie consults and advises on workplace issues; investigates complaints of harassment and other forms of misconduct; conducts training on harassment and other workplace topics; drafts policies, procedures and handbooks; represents employees and employers in non-litigation workplace matters; and acts as an expert witness on employment practices. She is an appointed member and vice chair of the Town of Wellesley’s Human Resources Board, overseeing a staff of five employees. She frequently conducts in-house seminars for employers and trade organizations and speaks at CLE programs for many organizations across the country. Julie has authored many publications in legal and trade journals. She earned her B.A. from Boston College in 1988 and her J.D. from Suffolk University Law School in 1992. She is a member of the American Bar Association, the New Hampshire Bar Association (since 1992), and the Massachusetts Bar Association (since 1995). Julie is a past chair and current member of the NHBA’s Labor & Employment Law Section. She is a former board member and conference chair for the Association of Workplace Investigators, a board member and program chair for the Greater Merrimack Valley Human Resources Association, and a member of the Society for Human Resources Management. Julie has SPHR and SHRM-SCP certifications in human resources. She was inducted into the College of Labor and Employment Attorneys in 2013.
Deborah Maddux is a Shareholder and Senior Partner in Van Dermyden Maddux Law Corporation, a California law firm that specializes in workplace investigations. Deborah has personally conducted hundreds of investigations into claims of misconduct, including claims of harassment, discrimination, retaliation and improper governmental activities. She has testified at hearings, depositions, and at trial regarding her process and findings. Deborah oversees her own team of attorney investigators, and has provided both in-house and private training regarding how to conduct effective investigations, with a focus on ensuring that internal reviews are fair and thorough, as required by law. In addition to her investigations practice, Deborah provides mediation services for workplace disputes. She also provides hearing officer services, and is a panel member for National Arbitration and Mediation (NAM).
A graduate of the University of California, Davis School of Law, Deborah is also a certified Senior Professional in Human Resources (SPHR and SHRM-SCP), as well as a certified EEOC investigator. She serves on the Executive Committee of the Labor and Employment Section of the State Bar of California as its Education Committee Chair.
Sue Ann Van Dermyden is a founding and Senior Partner of Van Dermyden Maddux Law Corporation, an investigations law firm. The Firm has a team of 18 attorneys dedicated almost exclusively to conducting workplace and campus investigations throughout California and Nevada. Sue Ann spent years litigating employment matters before focusing her practice on investigations. She is a founding member of the Association of Workplace Investigators, formed in 2009. Sue Ann has held almost every office and served on virtually every committee in AWI, and currently serves as the Board’s Immediate Past President. She also holds an AWI Accredited Certificate, from the AWI Institute. Sue Ann is the co-chair of the Workplace Investigations Subcommittee with the American Bar Association, Employee Rights & Responsibilities section. Sue Ann has been listed in Northern California Super Lawyers every year since 2010. She regularly speaks and acts as an expert witness on investigations. Sue Ann earned her Bachelor’s Degree from CSU Chico and received her J.D. from McGeorge School of Law.
