Employment Law Update

Murphy, Hesse, Toomey & Lehane, LLP - White House Rules: Navigating the Administration's Impact on Labor and Employment Law
This module will focus on EEOC actions that are impacting key areas in the employment arena such as LGBTQ rights, DEI, race and sex discrimination, and harassment. The panel will examine the changes, the impact for employers created by these changes and EEOC enforcement initiatives. We will consider these actions in light of the Massachusetts framework which, in some cases, diverges from the federal framework, and provide guidance on considerations for employers in navigating this complex, sometimes inconsistent, legal requirements between state and federal enforcement arms.
The Massachusetts Regulatory Environment
This module will highlight regulatory changes in Massachusetts that impact employers. The panel discussion will include the proposed changes to the MCAD regulations which will have a major impact on the investigation and processing of discrimination claims as well the impact of pay transparency.
Regulatory Environment on the Federal Front
This panel will review the regulatory environment on the federal front and highlight for employers how federal regulatory changes impact their workplaces. This discussion will include developments at the NLRB and the recently-issued independent-contractor rule replacement.
Separation Agreements
Employers often have questions about whether and when they should seek an agreement with an employee who is leaving voluntarily or involuntarily. In general, these agreements provide compensation in exchange for a release of claims. The panel will provide guidance on when to use separation agreements, when to avoid them, and what provisions to include.
Current Litigation Risks for Employers and How to Avoid Them
This module will provide an update of key court decisions over the past year at both the federal and Massachusetts state level that impact employers. We will look at the cases through the lens of:
- What risks are presented to employers through the cases?
- How can employers avoid the risks presented?
- What do the cases teach about preventive steps employers can/should implement.
The panel will engage in a discussion of practical take-aways from the notable cases.
